RETURN AGREEMENT

What should I do if my order is delivered incomplete, incorrectly, or damaged? In this case, you should ask the courier delivering your order to draw up a report and not accept the product. If you immediately contact SPR AMBAR by phone or email and provide the necessary information, your order will be compensated as soon as possible, and the shipping costs required for this process will be covered by SPR AMBAR. - Do you provide assembly services for products sold unassembled? All our products requiring assembly are offered for sale with an assembly guide. Upon request, assembly services are provided within the boundaries of Istanbul for a fee. Products can also be shipped assembled to other cities. However, in this case, the volume of the products will increase, and the shipping fee will increase accordingly. - What should I do if the product I purchased turned out to be defective/faulty? If the product you ordered was sent to you with a manufacturing defect, you may return it or exchange it for the same product, if available, within the warranty or liability period. Our customer service will provide you with the necessary support as soon as possible. - How can I return the product I ordered? You can return your order within 14 days from the date of receipt, provided that you have not used it and have not damaged the product or its packaging (its resale value). Within 14 days, you can send an email to info@sprambar.com stating your reason for return along with your order number and the relevant product code. After this step, you can deliver it to an MNG Kargo representative along with the package and all documents inside (warranty certificate, invoice, delivery note, shipping receipt, etc.) and have it delivered to us from SPR AMBAR on a prepaid basis. At this point, we ask you to package the product as securely as possible so that it will not be damaged. Following the arrival of your product to us, if no definite defect resulting from misuse or similar reasons is detected after inspection by our authorized personnel, the product price will be refunded to your bank according to your preferred payment method. If you wish, you may also submit your return requests through our store within 14 days from the date of receipt. In this case, it is sufficient to bring the product you wish to return to our SPR AMBAR store along with the invoice, delivery note, etc., all legal documents that came with it, and state that you wish to return the product you purchased online. After this step, the product you return will be received by our store and sent to our headquarters for inspection, and if there is no negative condition regarding the return terms, your refund will be made within 14 days according to your payment method. Products that are not reported within 14 days after receipt or whose resale value has been damaged will not be accepted for return by SPR AMBAR. Since the return of some products may not be possible due to certain conditions, we expect our customers to be sensitive about this matter. Except for products that turn out to be defective or faulty at the time of delivery, returns are not accepted for products that cannot be returned due to their nature, such as copyable products (Books, DVDs, VCDs, and CDs), and for single-use products if the original packaging is opened. Returns are also not accepted for products specially prepared and imported for specific days such as New Year's Eve, Valentine's Day, and Mother's Day, as well as for campaign and promotional products; customers agree to these conditions by making their purchase. The returned product will first be inspected by the service department within SPR AMBAR, and when it is determined that it meets all conditions, the return process, which will take effect within 3 to 7 business days, will be initiated. Note regarding corporate purchases: If the invoice of the product you will return is issued in the name of the company, you must send your return with a credit note issued by your company without including the shipping cost (product unit price + VAT). For all exchanges you make at our stores within 30 days, you can directly exchange it with the same product you purchased. If you choose a different product as the product you wish to exchange; if the price of the new product you purchased is above your refund amount, you can pay the difference in cash or by credit card. If the price of the product you purchased is lower than your refund amount, you may choose to make a purchase equal to the difference. In exchanges made at stores, the difference amount is strictly not refunded, and no transaction is made for later use. If you notify us that you wish to exchange the product you purchased with the same product within 30 days, our Customer Service personnel will direct our contracted courier company to you and collect the product and all promotional products and documents sent with the product (invoice, delivery note, warranty certificate, etc.) from you. After the product and accompanying promotional items and documents reach us, our customer service representative will contact you and guide you on the subject after the inspection is completed. - When can I get my payment back in case of a return? For payments made by credit card, the product amount will be refunded to your bank on the same day your return request is approved* and as soon as you are notified. Since the reflection of this amount to your accounts after its transfer to the bank is entirely related to the bank's processing time, SPR AMBAR will not intervene in any possible delays. It may take the bank an average of 1 to 2 weeks to reflect the amount refunded to your credit card into your account. Rights and Obligations 5.1 Rights and Obligations of the User. The User accepts, declares, and undertakes that they will act in compliance with all conditions in the User Agreement, the rules specified in the relevant sections of the Website, and all applicable laws and regulations while completing the membership procedure, benefiting from the Services of the Website, and carrying out any transaction related to the Services on the Website, and that they understand and agree to all the conditions and rules specified above. The User accepts, declares, and undertakes that, pursuant to the provisions of the Privacy Terms and the mandatory provisions of applicable laws and regulations, or in the event that it is alleged that the rights of other Users or third parties have been violated, SPR AMBAR shall be authorized to disclose its confidential/private/commercial information to both official authorities and the entitled persons, and therefore, no compensation may be claimed from SPR AMBAR under any circumstances. The security, storage, protection from third-party knowledge, and use of the access credentials (username, password, etc.) used by Users to benefit from the Services offered by SPR AMBAR are entirely the responsibility of the Users. SPR AMBAR shall not be held liable, directly or indirectly, for any damages suffered or that may be suffered by the Users and/or third parties due to any negligence or fault of the Users regarding the security, storage, protection from third-party knowledge, and use of their system access credentials. Users accept, declare, and undertake that the information and content they provide within the Website are accurate and lawful. SPR AMBAR is not obliged or responsible for investigating the accuracy of the information and content transmitted to SPR AMBAR by Users or uploaded, modified, or provided by them through the Website, nor is it obliged or responsible for guaranteeing that such information and content are secure, accurate, and lawful, and it cannot be held liable for any damages arising from the inaccuracy or error of such information and content. The User may not transfer their rights and obligations under the User Agreement, in whole or in part, to any third party without the written approval of SPR AMBAR. Those who benefit from the Services offered by SPR AMBAR and use the Website may only conduct transactions on the Website for lawful purposes. The legal and criminal liability of Users for every transaction and action they perform within the Website shall belong to them. Every User accepts, declares, and undertakes that they will not reproduce, copy, distribute, process, or otherwise compete with SPR AMBAR, directly and/or indirectly, in a manner that violates the property or personal rights of SPR AMBAR and/or another third party, nor will they reproduce, copy, distribute, display, reproduce, or create derivative works from images, texts, visual and auditory images, video clips, files, databases, catalogs, and lists located within the Website. SPR AMBAR cannot be held liable, directly or indirectly, under any circumstances for damages suffered or that may be suffered by third parties due to the Users' activities carried out on the Website in violation of the provisions of the User Agreement and/or the law. Users accept, declare, and undertake that they will not conduct transactions on the Website that would enable money transfers between their own memberships and those of their relatives, nor will they engage in behaviors that would manipulate the operation of the Website, and that they will compensate SPR AMBAR for any damages suffered as a result. 5.2 Rights and Obligations of SPR AMBAR. SPR AMBAR reserves the right to change the Services and content offered on the Website at all times; to restrict access to the information and content uploaded to the system by Users, including Users, and to delete such information and content. SPR AMBAR may exercise this right without any prior notice. The User shall immediately implement the changes requested by SPR AMBAR. SPR AMBAR may conduct necessary content and/or message scanning to detect messages and/or content that occur through the Website between Users and that are contrary to the operation of the Website and/or the User Agreement and/or the general rules of the Website and/or general moral rules, and that cannot be accepted by SPR AMBAR, and may remove such detected messages and/or content from access at any time and in any manner; and may terminate the User's membership temporarily or permanently without any prior notice. The approval and implementation of the User Agreement does not create a partnership, agency, or employer-employee relationship between SPR AMBAR and the User. The User undertakes not to violate the copyright, trademark, or commercial title rights of third parties when determining the "username". In the event that Users act in violation of the provisions of this article, SPR AMBAR may request the User to correct such violation of the Terms of Use, and may also cancel the User's membership temporarily or permanently without prior notice to the User. 6. Privacy Terms. SPR AMBAR may use information regarding Users in accordance with the provisions set forth in the Privacy Terms located on this Website. SPR AMBAR shall not use the confidential information of Users contrary to the User Agreement and the Privacy Terms. 7. Intellectual Property Rights. Users may not resell, share, distribute, display, reproduce, create or prepare derivative works from the SPR AMBAR Services offered through the Website, SPR AMBAR information, and works subject to SPR AMBAR's copyright, nor may they allow others to access or use SPR AMBAR's Services; otherwise, the licensors, including but not limited to third parties, shall be responsible for meeting the amount of compensation claimed from SPR AMBAR for damages suffered by third parties, as well as court costs, attorney fees, and all other obligations, including but not limited to these. SPR AMBAR reserves all property, real and personal rights, commercial information, and know-how rights, including all rights to SPR AMBAR Services, SPR AMBAR information, works subject to SPR AMBAR's copyright, SPR AMBAR trademarks, SPR AMBAR trade dress, and all types of tangible and intellectual property rights owned through the Website. Users accept, declare, and undertake not to violate any Intellectual Property Rights belonging to SPR AMBAR and other Users located on the Website. 8. Changes to the Agreement. SPR AMBAR may, entirely at its own discretion and unilaterally, change this User Agreement and its annexes at any time it deems appropriate by announcing such changes on the Website. The changed provisions of these Terms of Use shall become effective on the date they are announced; the remaining provisions shall remain in effect and continue to produce their legal effects. 9. Force Majeure. SPR AMBAR shall not be liable for any delay or failure to perform any of its obligations specified in this Agreement due to any circumstances legally considered force majeure. In cases of force majeure, delay, partial performance, non-performance, or default shall not be considered as such, and the User may not claim any compensation from SPR AMBAR under any circumstances. The term force majeure shall be interpreted as unavoidable events beyond SPR AMBAR's reasonable control and which could not have been prevented despite exercising due diligence, including but not limited to natural disasters, rebellion, war, strikes, cyberattacks, communication problems, infrastructure and internet failures, cyberattacks, improvement or renewal work related to the system and the failures that may arise as a result, power outages, and bad weather conditions. 10. Applicable Law and Competent Court. Turkish Law shall apply to the implementation and interpretation of this User Agreement and to the management of legal relationships arising within the scope of its provisions. The Courts and Execution Offices of Istanbul shall have jurisdiction over all disputes arising out of or related to this User Agreement. 11. Termination of the Agreement. This User Agreement shall remain in effect and continue to produce its legal effects between the Parties as long as the User accesses the Website and/or registers as a member; it shall be deemed terminated upon the expiration of the User's membership period or the temporary or permanent suspension of their membership. SPR AMBAR may unilaterally terminate the User Agreement and Users shall be obliged to compensate SPR AMBAR for all direct or indirect damages suffered due to the reason of termination in the event that Users violate these Terms of Use and/or similar rules regarding the User and membership and the Services located within the Website, and especially in the following cases: the User engages in behaviors that manipulate the operation of the Website using any method, the User transfers their user profile created for themselves to another person or makes it available for use, or the User commits acts that violate the rights of third parties. Every User who accesses and/or registers as a member of the Website shall be bound by the provisions of this Agreement indefinitely.

DELIVERY

When will the product I ordered be shipped, and how long will it take to reach me? SPR AMBAR aims to deliver the products you purchase to you as quickly as possible. For this reason, we keep the majority of the products we sell on the site in warehouses belonging to SPR AMBAR. Thus, unlike many other online sales websites, we do not need 3-4 extra days to procure the majority of our products before delivering them to the cargo company. (To offer you a wider variety of products, a small portion of our products is supplied from our stores. For these products, the delivery time to the cargo company varies between 3 and 7 business days. In this scope, your orders that have been fully paid and confirmed will be packaged and delivered to our cargo company within 3 business days. During campaign periods and for some products that can be supplied from our warehouses, there may be a delay of a few days in the shipping of orders.* For products produced specifically for an individual (hand-knitted cushions, custom-ordered pillows and cushions, etc.), the time may take up to 10-15 business days depending on the workshop's workload. After the order is confirmed, you will be informed about the exact delivery time. It is of great importance to us to deliver your orders to you as quickly as possible. Depending on the status of the delivery point you wish to receive at, this time may vary between 3 business days (major city centers) and 10 business days following the confirmation of your order. For your orders that have time constraints regarding delivery, we kindly request you to take into account the cargo shipping times.

- Will I pay a fee at and/or after delivery?
For the cargo service fee, our team members will contact you after you place your order. Depending on the quantity of the product you ordered and the delivery address, the most suitable cargo options will be communicated to you, and the method you desire will be followed.

- Why should I not accept packages that appear damaged and suspicious?
When your order reaches you, if you detect any damage or suspicious situation in the shipment package, please do not accept it. Ask the cargo courier to draw up a report and contact our customer service representative as soon as possible. If you accept such a package by signing the delivery receipt, you eliminate the possibility of detecting damages or losses that occurred during transportation. If you are not there again, your product will be sent back to the SPR AMBAR warehouse.
